1. Acceptance of these terms

By creating an account or otherwise using Fluent Prompter, you agree to these terms. We may update them as the product evolves, and your continued use after an update constitutes acceptance of the revised terms.

2. The service

Fluent Prompter lets you write, refine, save, version, and organise text prompts, and connect your library to AI assistants such as ChatGPT, Claude, and Cursor. Fluent Prompter is an editor and library: it stores and organises the text you write and does not generate prompts or answers for you.

We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected. You may not reverse engineer the service, resell or redistribute it, or circumvent technical limits such as plan character limits.

3. Your account and content

You must provide accurate account information and keep it up to date, and you are responsible for keeping your credentials confidential and for all activity under your account. You retain ownership of the prompts and other content you create, and you grant us a limited licence to host, store, and process that content solely to provide the service to you.

4. Acceptable use

You must not misuse the service. In particular, you must not:

• use the service for any unlawful purpose or in breach of applicable law;
• use it for fraud, spam, or unsolicited bulk messaging;
• upload or store content that infringes the intellectual property or privacy rights of others;
• interfere with the security or integrity of the service, including introducing malware, probing or scanning our systems, bypassing authentication, or scraping data; or
• store content that is unlawful, harassing, hateful, or otherwise abusive, or use prompts to plan unlawful or harmful activity.

You are responsible for the prompts you write and for how you use them with any third-party AI assistant, including confirming you have the rights to any content you paste in and verifying the accuracy of anything an AI assistant produces from your prompts.

5. Intellectual property

Fluent Prompter retains all ownership of the service and its intellectual property, including the software, design, documentation, name, and branding. Nothing in these terms transfers any of those rights to you. If you believe content stored on the service infringes your rights, contact us at support@fluentprompter.com and we will investigate and remove infringing content where appropriate; accounts responsible for repeated infringement may be terminated.

6. Plans, pricing, and billing

Fluent Prompter offers a Free plan and a paid Unlimited Plan. The Free plan includes the full Prompt Editor, the live word and character counter, saved prompts you can search, edit, and delete, Prompt Version History, connections to AI assistants such as ChatGPT, Claude, and Cursor, and a limit of 1,000,000 characters per prompt. The Unlimited Plan (Fluent Prompter Unlimited) costs $20.00 USD per month, removes the per-prompt character limit, and includes future premium features.

Subscriptions renew automatically each month until cancelled. You can cancel at any time from My Billing in My Settings and keep access through the end of your paid billing period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Refunds are covered by our Refund Policy, which includes a 30-day money-back guarantee.

7. Availability and disclaimer of warranties

We work to keep Fluent Prompter available and reliable, but the service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or free of data loss, and features may change over time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Keep your own copies of prompts that matter to you.

8. Suspension and termination

We may suspend or terminate your access to the service for material breach of these terms, non-payment for a paid plan, security or fraud risk, or repeated or serious policy violations. Where practical we will give notice and an opportunity to fix the problem first. You may stop using the service at any time and delete your account and its data from My Settings. When access ends, we delete your account data as described in our Privacy Policy.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill, and our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it to be excluded. You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.

10. General

You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control. Any disputes will be handled in the courts of the seller's jurisdiction under its governing law.
